IBB Adaptive Solutions GmbH attaches great importance to the protection of your personal data and the data and information provided to us. The collection, processing and use of these data as part of the use of the portal takes place exclusively in compliance with the following provisions and in accordance with the applicable data protection laws.

The BONSAI Partner Portal provides a basis to exchange data and information between trading partners. Your data will be made available to the respective communication partners via the system according to your entries.

All data processed via the BONSAI Partner Portal are only made available to the respective communication partner and are not passed on to third parties for processing or use.

In the following we would like to inform you which data are collected when using our offers on the BONSAI Partner Portal, how we process and use them and which rights you have in this context. In addition, we will explain to you which accompanying measures we have taken in technical and organizational terms to protect your data.

2. Personal data

Personal data are information about personal or factual circumstances that can be easily and clearly assigned to you. This includes, for example, your name, your address, your phone number, your email address or an online ID and a password.

3. Extent of the collection and use of your data including the purpose of processing

3.1. Use of the portal

If you use our service we collect and process the following data with your consent for the purpose of verifying your identity, delivering and fulfilling legal requirements:

  • your name
  • your email address
  • date, time and your IP address at the time of your consent
  • date, time and your IP address at the time of your confirmation of your consent
  • version of the data protection declaration at the time of consent and the content of the respective declarations

When you visit our website we collect and use data that your internet browser automatically transmits to us:

  • date and time of access to one of our websites
  • your browser type
  • your browser settings
  • your IP address
  • the pages you visited
  • the internet address of the website from which you were transferred to our website by clicking on a link (so-called referrer).

We use these data to technically enable you to visit our portal. We also use these data for statistical purposes to improve our services regarding design and layout.

3.2. Use of the contact form

You can contact us directly using the contact form provided on our website. We collect, process and use the personal data provided by you via this form (name, company, email address and phone number) and further information for the processing of your request and further support including giving you information about our services.

For this we use the FreshDesk service, a software solution of the company Freshworks, Inc., 2950 S. Delaware Street, Suite 201, San Mateo, CA 94403 (USA). Our service provider is based in a country outside the countries of the European Union ("third country"). In this case, Freshworks, Inc. is commissioned on the basis of the decision of the European Commission of July 12, 2016, according to which there is an adequate level of protection in the USA (adequacy decision according to Art. 45 GDPR). An adequate level of protection also exists for companies that are certified under the EU-US Privacy Shield. 4. Cookies

In order to make our offer as pleasant as possible for you we use so-called cookies like many other companies do as well. Cookies are small text files that enable the user to be recognized. We use cookies to set up a so-called session, i.e. to synchronize the status between our server and your web browser.

5. What is the legal basis for processing your data?

We process your personal data in compliance with the requirements of the European General Data Protection Regulation (GDPR) and the national data protection regulations to achieve the following purposes:

We process your personal data for the purpose of providing the content on our services for retrieval by the user. The processing takes place on the basis of Art. 6 Para. 1 Clause 1 lit. b) GDPR.

The same applies to the processing of personal data concerning the processing of your inquiries communicated via the contact form.

We also process your personal data if you have given us your consent. In this case, processing takes place on the basis of Article 6 (1) sentence 1 lit. a) GDPR. When we collect your consent, we will inform you about the specific purpose of the intended processing. You can revoke your consent given to us at any time for the future. We will inform you about the possibility of withdrawing consent when you give your consent. We need your consent, for example, to send our newsletter.

Finally, we process your data insofar as we have a legitimate interest in this unless your interests or fundamental rights that require the protection of your personal data outweigh this interest. In this case, processing takes place on the basis of Article 6 (1) sentence 1 lit. f) GDPR. This processing includes the use of the cookies mentioned above and the use of tools to evaluate your usage behavior.

6. Who will we share your data with?

The BONSAI Partner Portal is used to exchange data and information between trading partners. Your data will be made available to the respective communication partners via the system corresponding to your entries.

Within IBB, your data will be made available to those departments that need them to fulfill a contract or to carry out pre-contractual measures. In addition, those departments will receive your personal data that process them on the basis of a legitimate interest.

As far as this is necessary, we also pass on data to supporting service providers (e.g. postal service providers, IT service providers and legal advisers).

Your data will only be passed on to third parties outside of IBB and your communication partners if there is a legal obligation to do so (e.g. law enforcement authorities).

7. Will we transfer your data to an international organisation or a third country?

We have integrated the above-mentioned technical service providers to process your data. Insofar as they process your data in a country outside the states of the European Union ("third country"), we have informed you about that in the information on the service provider concerned.

Should we commission further or other service providers to operate this service in the future, who do not process the data of the users of our service in a country of the European Union, this will only take place if, based on a decision of the European Commission, it is clear that in the third country concerned an adequate level of protection (Art. 45 GDPR) is given or, in the absence of such a decision, there are suitable guarantees for the protection of your data and enforceable rights and effective legal remedies are available to you (Art. 46 GDPR). In any case, we will conclude an order processing agreement with these service providers based on the EU standard contractual clauses before the transfer of personal data.

8. How long will your data be stored by us?

We store your personal data for the duration of the use of our service. If and insofar as your data is subject to tax, commercial or other legal retention requirements, we store this data in accordance with the respective retention requirements.
